Return Policy and Limited Warranty

Return Policy

If you are unsatisfied with a MM Device you purchased from MachineMetrics, Inc. (“MM”) on MM’s website or via a mutually executed, active statement of work with MM (a “Statement of Work”), you have from the later of thirty (30) days from receipt or integration of such purchase to request a full refund. “MM Device” means a device, being a physical piece of hardware provided by MM to monitor your assets or machines using MM’s software-as-a-service manufacturing analytics platform (the “MM Services”). To qualify for a refund, you must meet all of the following conditions:

• A return must be requested from MM’s Customer Support Manager by addressing an email to support@machinemetrics.com within thirty (30) days of the date on which you received the MM Device.
• Any accessories originally included with the MM Device you purchased must be included with your return.
• Returned MM Devices must be in good physical condition (not physically broken or damaged), in either its original packaging or packaging that provides an equal degree of protection. The return authorization number must be included along with your returned MM Device.

Shipping and handling charges and all taxes paid (e.g., state, customs, VAT) are not refundable. You are responsible for and must prepay all sales tax and shipping charges for returns or replacements after the one year warranty. If you did not elect at the time of purchase of the MM Device to use your own FedEx or UPS account for shipment, MM will bill shipping costs for the replacement MM Device(s) directly to you. You shall assume all risk of loss or damage to any MM Device while in transit to MM. If you return a MM Device to MM without a return authorization number from MM or without all parts included in the original package, MM retains the right to refuse delivery of such return.

Once your return is received and inspected, MM will send you an email to notify you that MM has received your returned MM Device. MM will also notify you of the approval or rejection of your refund request. If your request is approved, your refund will be processed, and a credit will automatically be applied to your MM account, credit card, or original method of payment. Refunds will be processed and paid within two (2) weeks of MM’s receipt of the returned MM Device.

Limited Warranty

Provided that you have an active Statement of Work in place with MM, MM warrants to you, for a period of twelve (12) months from the effective date of such Statement of Work (the “Warranty Period”) that: (i) the MM Devices purchased by you under such Statement of Work will be free of defects in material or workmanship and (ii) the MM Devices purchased by you under such Statement of Work will perform in substantial accordance with the documentation provided by MM that describe the features, functions and operation of the MM Services (the “Documentation”). MM shall, at its sole option, either repair or replace any material failure of the MM Devices to comply with such warranty of which you provide written notice to MM during the Warranty Period. The foregoing sets forth MM’s sole obligation and your sole and exclusive remedy for any breach of the foregoing warranty and MM reserves the right for any repairs or replacements to consist of new or refurbished components. This warranty is extended only to you and not to any other party. Any parts or replacement MM Devices provided to you hereunder shall not extend the original Warranty Period. This warranty does not cover defects resulting from: (a) use of the MM Devices other than in a normal and customary manner in accordance with the Documentation; (b) alterations or modifications made to the MM Devices that are not authorized in advance by MM in writing; or (c) combination of the MM Devices with third party hardware or software not authorized in advance by MM in writing. In order to receive any remedies under this warranty, you must ship the nonconforming MM Devices back to MM in accordance with the MachineMetrics Return Policy. The foregoing warranty does not apply to MM Devices provided at no cost for a trial period, unless and until you are invoiced for such MM Devices.
